1. Binding Agreement
By accessing the AMY INSTANT website and purchasing our custom audio architecture, you are entering into a legally binding contract with WonderMana LLC ("Company," "we," "us," or "our"). These Terms and Conditions govern your use of our services, website, and the digital audio files provided to you.
2. Strict No-Refund Policy
AMY INSTANT provides premium, highly customized digital audio products. Due to the irreversible nature of digital goods and the immediate allocation of production resources upon order placement, ALL SALES ARE FINAL.
- Once an order is submitted and payment is processed, no refunds, cancellations, or chargebacks will be permitted under any circumstances.
- By completing your purchase, you acknowledge and agree to waive any right to a refund.
3. Revisions & Modifications
We pride ourselves on meticulous audio architecture tailored to your story. However, we understand that slight adjustments may be desired.
- Premium/Founders Tiers: Clients purchasing at higher tiers are entitled to exactly one (1) complimentary revision.
- Scope of Revision: This revision is strictly limited to minor adjustments within the same musical genre and general structure originally requested.
- A revision request does not constitute a complete recreation of the track in a new genre or a drastic deviation from the initial creative brief. WonderMana LLC reserves the sole right to determine what constitutes a minor adjustment versus a new track request.
- Additional revisions beyond the one (1) included, or requests for complete genre changes, will require the purchase of a new track at the standard rate.
4. Licensing & Usage Rights
WonderMana LLC retains full copyright and ownership of all underlying musical compositions and master recordings created by AMY INSTANT. Upon delivery of the final audio file, you are granted a specific license based on your purchase:
- Personal Use License: If the track is purchased for a milestone, wedding, birthday, tribute, or family event, you are granted a perpetual, non-exclusive, worldwide license to use the audio for personal, non-monetized purposes. You may share it on personal social media accounts, but you may not use it to generate direct revenue.
- Commercial / Brand Promotion License: If the track is purchased under the "Brand Promotion," "Podcast Theme," or similar commercial categories, you are granted a non-exclusive, worldwide license to use the audio in synchronization with your business marketing, YouTube videos, and advertisements.
- Restrictions: Under no circumstances may any client resell, repackage, redistribute, or upload our standalone tracks to streaming platforms (e.g., Spotify, Apple Music) as their own original musical work or register them with Content ID systems.
5. Limitation of Liability
To the maximum extent permitted by applicable law, WonderMana LLC, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our services or audio products. This includes, but is not limited to, loss of profits, loss of data, or business interruption.
Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount you paid to WonderMana LLC for the specific audio track in question.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State in which WonderMana LLC is registered, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to, or use of, the website or services shall be instituted in a state or federal court in that jurisdiction.
